Yes you can have open containers on a boat in NY. but you will be subject to BUI laws if your blood alcohol level is above .08 while driving the boat, and there is zero tolerance for under age drinking. also alcohol is one of the greatest factors involved in fatal boating accidents. there are other problems related with drinking while boating including fatigue and dehydration. you are much better off having a designated driver while boating or waiting until after your done boating to do your drinking. the following web site has the more info state.nj.us/ njsp/ info/ pdf/ marine/ 021606-boating-safety-manual.pdf "OPERATING A VESSEL UNDER THE INFLUENCE OF INTOXICATING LIQUOR, DRUGS OR NARCOTICS You cannot operate a vessel while under the infl uence of intoxicating liquor, a narcotic, hallucinogenic or habit-producing drug or with a blood alcohol concentration of 0.08% or more. Furthermore, if you are the owner of a vessel or are in control of a vessel, you cannot allow someone else who is under the infl uence of intoxicating liquor, a narcotic, hallucinogenic or habit-producing drug, or who has a blood alcohol concentration of 0.08% or more, to operate the vessel. If your blood alcohol concentration is 0.08% or higher but less than 0.10%, you will face a fi ne of not less than $250 nor more than $400. You will also lose the privilege to operate a vessel on the waters of this State for a period of 12 months from the date of conviction along with the forfeiture of your driver’s license, which will be forwarded to the Director of the Motor Vehicle Commission, for a period of three (3) months.
